Stevens
Senior Reclamation Specialist
Mined Land Reclamation Division
215 Centennial Bldg.
1313 Sherman St.
Denver, CO
Dear Mr. Stevens:
RE: Emergency Placement of Pond Cleanings
Mid-Continent requests permission to use berming and the creation
of surface depressions for containment of pond cleanings from the
three pond series of outfall ##016, also known as the tunnel ponds,
on the rock tunnel pile for the duration of the emergency
conditions which now exist at these ponds.
This request is made in connection with the MLRD cease and desist
order issued June 29, 19ag for the 016 pond series.
Mid-Continent is operating under emergency conditions, and time
factors in cleaning the tunnel ponds are critical . Use of the
tunnel pile for placement of the cleanings will allow signicant
time savings, and berming is necessary to contain the cleanings.
This request is temporary in nature, and applies only to the
duration of the emergency situation. MLRD has indicated to Mid-
Continent, and it is understood by us, that any practice which
allows surface depressions on the tunnel pile is unacceptable to
i MLRD as a normal maintenance procedure.
Very truly yours,
Diane Delaney
Mid-Continent Res.
l (1i
