RE: NOV C-93-108 and MR-42 ; Coal Basin Mines (C-81-017)
Dear Ms. Delaney:
Abatement of NOV C-93-108, which was issued for failure to include
ownership and control information for the Coal Basin Mines,
required submittal of identification of interest information for
appropriate officers of Pitkin Iron Corporation, as required by
Rule 2 . 03 .4 (3) . Abatement of the NOV was due by October 8, 1993 .
In response to the NOV, Mid-Continent submitted MR-42 with
ownership and control information. The revision was received by DMG
on September 3 , 1993 .
The proposed revision does not contain information regarding
officers of Pitkin Iron. It does include an explanation that
Pitkin Iron is not an owner or controller, as defined by the
regulations. DMG does not agree with Mid-Continent's contention
that Pitkin Iron does not meet the regulatory definition of owner
and controller. Because DMG has just completed review of the
proposed revision, the due date for abatement of the NOV is being
extended to October 30, 1993 . This will allow Mid-Continent time
to respond to this letter.
In the proposed revision, MCR contends there is no applicant or
operator conducting surface coal mining operations on the site.
The definitions of "applicant" and "operator" in Rule 1. 04 are used
as the basis for this contention. However, the relevant section of
Rule 1. 04 (83a) also refers to any "other entity" conducting surface
coal mining operations.
