Your request was <br /> submitted by letter dated September 15, 1993 . The project is <br /> located in Section 29, Township 10 South, Range 88 West, Pitkin <br /> County, Colorado. <br /> The Chief of Engineers has issued nationwide general permit <br /> number 13 which authorizes the discharge of dredged and fill <br /> material in waters of the United States for bank stabilization. <br /> Your project can be constructed under this authority provided the <br /> work meets the terms and conditions listed on the enclosed <br /> information sheet. <br /> The purpose of this project is to reduce erosion of the <br /> stream bank of Dutch Creek to prevent coal refuse stored above <br /> the eroded bank from collapsing into the channel. Although we <br /> approve the rip-rap project as proposed, we suggest that a more <br /> permanent solution be developed next year. Because of the debris <br /> flows that the channels in the Coal basin experience, a more <br /> permanent solution would be to either relocate the channel away <br /> from the eroding bank, or remove the coal refuse piles to another <br /> location. If a channel relocation is planned, an individual <br /> Department of the Army permit would be required. <br /> This verification is valid for a period of two years from <br /> the date of this letter unless the nationwide general permit is <br /> modified, suspended, or revoked. You should contact this office <br /> if work will extend beyond this date. <br />
