Pineda <br />Florence, CO 81226 Director <br />Re: Southfield Mine (Permit No. C- 1981 -014) <br />Minor Revision No. 58 (MR- 58) <br />Subsidence Mitigation Plan <br />Dear Mr. Patterson: <br />We have received your minor revision application to revise your permit to conduct coal mining in Colorado. Our initial <br />review indicates that all preliminary items required by the Colorado Surface Coal Mining Reclamation Act, Section <br />34 -33 -101 et seq., C.R.S., have been submitted. Thus, your application has been considered complete for the purposes <br />of filing as of October 17, 2012. All review and comment periods as provided in the Act and the Regulations initiate <br />from this date of filing. <br />The Division has reviewed your revision application to determine whether the items you have submitted are adequate in <br />terms of meeting the requirements of the Act and Regulations. Please find the Division adequacy concerns: <br />1. The area associated with the mitigation of the subsidence holes is considered disturbed area. Please update the <br />application form to reflect this additional disturbance associated with the areas associated with the holes, the <br />area associated with the fill material footprint, the travel corridor utilized to access the mitigation area, and any <br />other areas that have been disturbed during the mitigation of the holes. <br />2. The map provided was at a scale of 1 inch equals 1000 feet (1" = 1000'), and only depicts permit area <br />boundary, coal and surface ownership limits. This map is inadequate to reflect the extent of the mitigation <br />work. An appropriate depiction would be at a 1" = 400' scale. (Rule 2.10.1(1)) This revised map should <br />include all approved surface disturbance at the mine area (Map 12 would be an appropriate map to add this <br />information to). <br />The Division's proposed decision date is October 27, 2012. Submittal of the requested information prior to October 27, <br />2012 will allow the Division time to review EFCI's submittal within the regulatory timeframe. <br />If you have any questions, please contact me. <br />Sincerely, <br />Janet H.
