Dear Mr. Bowman:
Enclosed are justifications for the proposed civil penalty assessment sent to
you recently.
The proposed civil penalties were arrived at using the system for assessment
of civil penalties in Rule 5.04. 5. An assessment of $50.00 was made for
history of previous violations for each of the violations since Mid-Continent
had one violation in the preceding year that has been through the
administrative process.
To simplify the process, a matrix identifying the proposed civil penalty for
the seriousness component is given below. This matrix addresses all possible
combinations of the factors (probability of occurrence, duration of damage,
and extent of damage) to be considered within the seriousness component.
