Box 158 <br /> Carbondale, Colorado 81623 <br /> Re: Notice of Proposed Civil Penalty, Request for Conference - Cessation <br /> Orders C-84-083 and C-84-084, File No. C-017-81 <br /> Dear Mr. Bowman: <br /> Enclosed are Proposed Amount of Civil Penalty and Request for Conference forms <br /> for the above referenced Cessation Orders. <br /> The Division proposes to assess a civil penalty of $8,800.00 for Cessation <br /> Order C-84-083 and $13,200.00 for Cessation Order C-84-084. The proposed <br /> civil penalties were arrived at using the system for civil penalty assessment <br /> in Rule 5.04.5. In addition, a separate civil penalty is proposed for four <br /> days in the case of CO C-84-083 and six days for CO C-84-084, in accordance <br /> with Rule 5.04.6. <br /> The civil penalty for each day for both cessation orders is broken down into <br /> $50.00 for history of previous violations, 11,400.00 for seriousness and <br /> $750.00 for fault. The method for arriving at these figures is discussed <br /> below. <br /> Mid-Continent has has one violation (NOV 83-27) in the previous year that has <br /> been through the administrative process. Therefore, $50.00 is assessed for <br /> the previous violation. <br /> The seriousness component is broken down into: 1 . The probability of <br /> occurrence of the event which a violated standard is designed to prevent; and, <br /> 2. The duration and extent of the potential or actual damage in terms of area <br /> and impact in the public environment. The maximum civil penalty assessment <br /> for seriousness is $1,750.00. For the purposes of this assessment, each <br /> portion of the seriousness component is given equal weight, i .e. , $875.00 <br /> maximum for each portion.
