FINDING OF VIOLATION <br /> During the May, 1984 inspection, Jim Herron, of the Mined Land <br /> Reclamation Division, observed that topsoil which had been stockpiled <br /> during construction of an exploration pad had not been salvaged. The <br /> topsoil had been placed along the edge of the wash plant slurry pond. <br /> Also, it was observed that topsoil removed during construction of a <br /> drainage ditch south of the warehouse was not picked up and transported <br /> to an approved topsoil stockpile. These two observations are the basis <br /> upon which NOV 84-087 was issued. <br /> During the hearing the operator pointed out that the topsoil stockpiled <br /> near the slurry pond was to be removed to the approved topsoil <br /> ►,A '" stockpile during the time period of the inspection. The exploration <br /> o activities required the resence of the stockpiled inaterial to serve as <br /> a bench for the explor tin A rill rig. The drill rig was removed three <br /> days prior to the inspec ion, with a weekend in between. <br /> Although trace amounts of topsoil were spilled onto the banks of the <br /> slurry pond, it is not clear that such spillage could have been avoided <br /> even if topsoil salvage would have occurred immediately after the drill <br /> rig departed. There is no evidence that the operator did not intend to <br /> salvage this topsoil material . No appreciable amount of topsoil was <br /> lost at this site. <br /> The operator claimed that the material which was stockpiled adjacent to <br /> the drainage ditch was also scheduled for removal and stockpiling in an <br /> {, approved location. Since the Division presented no information to the <br /> contrary, and no topsoil was contaminated or lost during salvage <br /> operations, there is considerable doubt as to whether a violation <br /> occurred here, either. <br /> 423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
