-36-
NOV C-84-154
Mid-Continent Coal Resources, Inc.
I. FINDING OF VIOLATION
During the August 15 and 16, 1984 inspection, Jim Herron, of the Mined
Land Reclamation Division, observed that large amounts of coal
processing waste were being deposited at the underground rock disposal
pile. At the time of this inspection this activity was not approved by
the Mined Land Reclamation Division. A technical revision was pending
at the time of this inspection which would have authorized such
disposal practices. Since the approved refuse disposal area was too
wet to allow trucks access to that area, there was no location except
the underground rock disposal pile which was suitable for coal
processing waste disposal . The coal processing waste disposal
practices at the underground rock disposal pile were being conducted in
an environmentally sound manner. Nevertheless, this was not a
permitted activity and the Director finds that the violation occurred.
NOV C-84-154 is upheld.
II. PENALTY ASSESSMENT
No civil penalty is assessed.
