-36- <br /> NOV C-84-154 <br /> Mid-Continent Coal Resources, Inc. <br /> I. FINDING OF VIOLATION <br /> During the August 15 and 16, 1984 inspection, Jim Herron, of the Mined <br /> Land Reclamation Division, observed that large amounts of coal <br /> processing waste were being deposited at the underground rock disposal <br /> pile. At the time of this inspection this activity was not approved by <br /> the Mined Land Reclamation Division. A technical revision was pending <br /> at the time of this inspection which would have authorized such <br /> disposal practices. Since the approved refuse disposal area was too <br /> wet to allow trucks access to that area, there was no location except <br /> the underground rock disposal pile which was suitable for coal <br /> processing waste disposal . The coal processing waste disposal <br /> practices at the underground rock disposal pile were being conducted in <br /> an environmentally sound manner. Nevertheless, this was not a <br /> permitted activity and the Director finds that the violation occurred. <br /> NOV C-84-154 is upheld. <br /> II. PENALTY ASSESSMENT <br /> No civil penalty is assessed. <br />
