AWN <br /> ' -r�- <br /> NOV C-84-093 <br /> Mid-Continent Resources, Inc. <br /> I. FINDING OF VIOLATION <br /> During the May, 1984 inspection, Jim Herron, of the Mined Land <br /> Reclamation Division, observed that three areas (i .e. , the valley <br /> directly east of Mine No. 1 , the Mine No. 1 and 2 sediment pond site, <br /> and the Arctic Circle pond site) where non-coal waste had been <br /> improperly disposed. Based on oral testimony, slides, and photographs, <br /> the Director finds that the violation occurred, and NOV C-84-093 is <br /> upheld. <br /> II. PENALTY ASSESSMENT <br /> A. History: <br /> Based on the fact that one violation was issued against <br /> Mid-Continent Coal Resources within the twelve months prior to this <br /> NOV, $50.00 is assessed. <br /> B. Seriousness: <br /> The rationale for the proposed assessment supports the final <br /> assessment for seriousness. $225.00 is assessed for seriousness. <br /> C. Fault: <br /> The rationale for the proposed assessment supports the final <br /> assessment for fault. $250.00 is assessed for fault. <br /> D. Good Faith: <br /> The operator abated this violation well ahead of the deadline. In <br /> addition, in cleaning up the trash at the Mine No. 1 site, a great <br /> deal of debris which had been deposited in the several decades <br /> prior to the passage of PL 95-87 was cleaned up. Based upon this <br /> favorable response, $50.00 is awarded for good faith. <br /> E. Total Assessment: <br /> The tgtal civil penalty assessment for NOV C-84-093 is $475.00 <br />
