Shelton �vitfw {3 r �ry <br /> Director IREC+_ <br /> Mined Land Reclamation Division ^!,0.; <br /> 423 Centennial Building <br /> 1313 Sherman Street <br /> Denver, CO 80203 <br /> Dear Mr. Shelton: <br /> Reference is made to Order issued by you dated <br /> July 5, 1985 to this company to show cause why our Permit <br /> No. C-017-81 should not be suspended or revoked. <br /> It is our understanding that it is not your desire <br /> to put us out of business by closing the property permanently, <br /> but rather to impose additional punitive sanctions which you <br /> apparently feel will serve some useful purpose in protecting <br /> the environment. <br /> We assume you are fully aware of the plight of the <br /> coal industry in this state; the fact that this company ' s <br /> coal operations have for the past several years lost sub- <br /> stantial sums of money; and the fact that our survival and <br /> the jobs of over 700 employees depend on our getting these <br /> operations turned around and the fact that even a one day <br /> shutdown imposes a severe economic hardship greater than <br /> that occassioned to a profitable company. <br /> There are additional factors concerning even a <br /> short shutdown of our operations about which you and the <br /> Board should be apprised for which you should be prepared to <br /> accept responsibility. <br /> The Federal Coal Mine Health & Safety Act, enforced <br /> by the Mine Safety & Health Administration (MSHA) mandates <br /> inspection, monitoring and numerous safety procedures that <br /> must be carried out on a daily basis. These are more <br /> extensive, more stringent and more rigidly enforced in our <br /> mines than in any other properties that we are aware of. <br /> They include fan inspections, water pumping, methane drainage, <br />
