CONSENT AGREEMENT AND ORDER
IN THE MATTER OF SHOW CAUSE ORDER OF JULY 5 , 1985 ISSUED TO
MID-CONTINENT RESOURCES , INC.
Mid-Continent Resources , Inc . ("Mid-Continent") , the
Mined Land Reclamation Division of the Colorado Department
of Natural Resources ("the division") , and the Mined Land
Reclamation Board of the Colorado Department of Natural
Resources ("the board") , in order to settle and resolve all
issues related to the above-referenced matter, enter into
the following consent agreement and order;
RECITALS
1. Mid-Continent operates a series of underground coal
mines , known as the Coal Basin Mines , in Pitkin County, Colorado .
2 . Mid-Continent holds mined land reclamation permit No .
C-017-81, and is required to operate the Coal Basin Mines in
compliance therewith, pursuant to the Colorado Surface Coal
Mining Reclamation Act , sections 34-33-101 through 137 , C .R.S .
(1984) .
3 .' On June 11 , 1985 the division determined that four
patterns of violations existed at the Coal Basin ?Tines . The
division' s pattern of violations determination is attached
hereto as exhibit A.
4. Pursuant to section 34-33-123 (7) , C.R.S . (1984) , on
July 5 , 1985 the division issued to Mid-Continent an order to
show cause why permit should not be suspended or revoked ("the
show cause order") , wherein the division stated that it had found
that the violations constituting the patterns of violations
referred to in paragraph 3 had been caused by the unwarranted
failure of Mid-Continent to comply with the requirements of
permit No. C-017-81 , the Colorado Surface Coal Mining Reclamation
Act , and the "Regulations for Coal Mining , " 2 CCR 407-2 .
A copy of the show cause order is attached hereto as exhibit
B.
