BEFORE THE MINED LAND RECLAMATION BOARD <br /> DEPARTMENT OF NATURAL RESOURCES <br /> STATE OF COLORADO <br /> CONSENT AGREEMENT AND ORDER <br /> IN THE MATTER OF SHOW CAUSE ORDER OF JULY 5, 1985 ISSUED TO <br /> MID-CONTINENT RESOURCES , INC. <br /> Mid-Continent Resources, Inc. ("Mid-Continent") , <br /> the Mined Land Reclamation Division of the Colorado Department <br /> of Natural Resources ("the division" ) , and the Mined Land <br /> Reclamation 3oard of the Colorado Department of Natural <br /> Resources ("the board") , in order to settle and resolve all <br /> issues related to the above-referenced matter, enter into <br /> the following consent agreement and order: <br /> RECITALS <br /> 1. Mid-Continent operates a series of underground <br /> coal mines, known as the Coal Basin Mines , in Pitkin County, <br /> Colorado. <br /> 2. Mid-Continent is the permittee under mining <br /> and reclamation permit No. C-017-81, approved and issued by <br /> the division and is required to operate the Coal Basin Mines <br /> in compliance therewith, pursuant to the Colorado Surface <br /> Coal Mining Reclamation Act, sections 34-33-101 through 137 , <br /> C.R.S. (1984) . <br /> 3. On June 11, 1985 the division determined that <br /> patterns of violations existed at the Coal Basin Mines . The <br /> division' s pattern of violations determination is attached <br /> hereto as exhibit A. The division acknowledges that all <br /> violations contained in these determinations of patterns of <br /> violations were fully and timely abated and all civil <br /> penalties fully and timely paid. <br /> 4 . Pursuant to section 34-33-123 (7) , C.R.S. <br /> (1984) , on July 5, 1985 the division issued to Mid-Continent <br /> an order to show cause why permit should not be suspended or <br /> revoked ("the show cause order" ) , wherein the division <br /> stated that it had found that the violations constituting <br /> the patterns of violations referred to in paragraph 3 had <br /> been caused by the unwarranted failure of Mid-Continent to <br /> comply with the requirements of permit No. C-017-81, the <br />
