MEMO <br />TO: Interested Parties <br />FROM: Rob Laird, Resource Manager ' <br />DATE: August 3, 2012 <br />RE: State Mining Amendment to Turnpike Mining Resource No. M- 2004 -009 <br />CC: File <br />Attached to this memo is the required legal notice to be sent to all property owners within <br />200 ft. of the referenced mine site permit area, all holders of mineral easements within <br />the permit boundary, and all owners of record of land within the permit boundary by the <br />Division of Reclamation, Mining and Safety ( "DRMS "), the state regulatory agency that <br />permits sand and gravel mining in the state of Colorado. This amendment to the Turnpike <br />Mining Resource does not expand either the permit area or the area to be mined. This <br />amendment is to prepare for removing the Town of Erie's wastewater treatment plant and <br />reservoir from the permit area and to stabilize and remove the shale stockpiles (from <br />reservoir construction) from their current location by burying them in place of the mined <br />out sand and gravel in the area we are currently mining (between Hwy. 52 and the central <br />area of the mine permit). The shale stockpiles should shortly, in all likelihood, be <br />stabilized with vegetation prior to removal and burial onsite. This action will preclude <br />wind and water erosion until the piles can be buried. Below is a description of how this <br />amendment will affect each interested party: <br />ADJACENT PROPERTY OWNERS: No expansion of the permit area or increased area <br />to be mined within the permit area and stabilization of the shale stockpiles from wind and <br />water erosion. <br />OIL AND GAS OPERATIONS AREAS and GAS TRANSMISSION LINE <br />LOCATIONS: No change. All well and tank battery operations areas are protected from <br />mining and reclamation activities by the Surface Use Agreements signed and in -place and <br />all transmission lines are protected by agreements and offsets in -place between the <br />operator and the gas transmission line companies. <br />UTILITIES: No change or no effect. All utilities (especially those going to the Erie <br />wastewater treatment plant and along State Hwy. 52) are located within designated and <br />legally defined Rights -of -Ways with approved offsets. <br />IRRIGATION DITCH: No change. This amendment only affects areas east of Boulder <br />Cr. The Plumb and Dailey Ditch is on the west side of Boulder Cr. and no mine plan <br />changes are being proposed for this area. Agreements and designs protective of the ditch <br />functionality and wetland seep are in place and on file with the DRMS. <br />Please contact me at the above location and phone number if you have any questions or <br />concerns. <br />
