The fuel storage tanks and secondary containment structures were in good condition. No <br />problems were noted. <br />Recent rains created damp ground conditions. Fugitive dust was not a problem during this <br />inspection. <br />Records Check: Some records have been moved to Mr. Kiger's office at the Elk Creek Mine, the <br />remainder is available at the TC Loadout office. This office is locked and staff is only present <br />when an order is received, so any interested party would need to contact Mr. Kiger to review <br />records. The following records were available at Oxbow's Elk Creek Mine office: Terror Creek <br />Loadout DRMS permit, Minor Revisions, Permit Renewals, and inspection reports. The <br />following records were available at the Terror Creek Loadout office: DRMS permit C- 1983 -059 <br />(expires 8/23/2013), RN -5 (issued 5/23/2008), liability insurance (expires 6/1/2013), <br />performance bond documents ($278,000), bond cost calculation ($273,000), air pollution / <br />construction permit, 2011 Annual Reclamation Report (1/4/2012), mid -term review (issued <br />2/23/2011), sediment pond certifications (3/16/1985), second quarter pond inspection reports <br />(7/9/2012), 2011 Annual Hydrology Report, and wastewater discharge permit COG - 850028 <br />(issued 1/29/2009). <br />No compliance issues were noted and no enforcement actions were taken as a result of this <br />inspection. <br />
