Rule 2: Permits <br />Evergreen and LCC are operating at each party's sole risk and agree thatdamages caused by the <br />negligence of either party will be compensated for at cost by the responsible party. Pertinent <br />pages of this lease are included in Exhibit 2 of LCC's permit documents. <br />LCC will conduct blasting only during times announced in the blasting schedule except where <br />safety requires the mitigation of unavoidable hazazdous situations. No blasting to mitigate <br />unavoidable hazardous situations will be conducted without prior notice to the Division. LCC <br />will deviate from the blasting schedule when unavoidable hazardous situations are determined to <br />exist and safety requires any of the following actions to mitigate the following situations: <br />a) destruction of damaged or deteriorated explosives or detonators in a safe manner; <br />b) disposal of misfires and/or undetonated explosives; <br />c) firing of charged holes when weather conditions (lightning, heavy rain/snow, high <br />winds) indicate that the existence of a safety hazazd is imminent <br />LCC will use the scaled distance equations of Rules 4.08.4(10)(c) and 4.08.4(10) during its <br />blasting operations to determine maximum weight of explosives that may be detonated within <br />any 8-millisecond period.
