OBSERVATIONS <br />PERMIT #: M- 1977 -342 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: September 27, 2012 <br />The Henderson Mine was inspected by Peter Hays and Tom Kaldenbach with the Division of Reclamation, <br />Mining and Safety (Division) as part of the Division's monitoring inspection program. Mr. Miguel Hamarat with <br />Climax Molybdenum (Climax) was present during the inspection. The inspection consisted of a discussion of <br />the outstanding permitting actions, the status of pending and future permitting submittals, a tour of the mill <br />and tailings storage facilities and observation of the recent monitoring well installation work related to TR -16, <br />the new topsoil stockpile area and the additional work required at the 3 -Dam Seep Collection area. <br />TR -10 Installation of a groundwater interception well field below the tailings impoundment: <br />Henderson stated URS recreated as -built drawings for the interception well field last year (2011). The <br />monitoring wells planned for downstream of the well field have not been installed to date. The transducers <br />have been installed in the piezometers adjacent to the containment wells. The downstream piezometers are <br />no longer planned; instead Henderson is proposing to perform pump tests on the containment wells. <br />TR -16 Groundwater Monitoring Plan: <br />Nine (9) new wells were installed in 2012 as part of the continuing groundwater studies at the Mill to <br />determine the following: <br />• The appropriateness of MLGW -7's current location and the rationale for or against a nested well at this <br />location. <br />• The appropriateness and recommended location of a POC well below 3 -dam and the rationale for or <br />against a nested well at this location. <br />• The appropriateness and recommended location of a POC well in the Potato Gulch drainage and the <br />rationale for or against a nested well at this location. <br />The new wells were installed with a sonic drill rig which enabled the wells to be continuously sampled and <br />logged by Henderson. In general, the deep (bedrock) wells were screened at lower intervals and the Pre - <br />Cambrian and Troublesome Formations did not indicate the presence of groundwater during drilling. <br />TR -15 Additional Topsoil Stockpile area: <br />The new topsoil stockpile area approved by the Division on July 2, 2012 had been further grubbed and cleared, <br />but no topsoil has been placed in the area since the July 17, 2012 inspection. The existing topsoil stockpiles <br />and hillsides associated with the road cut for the new storage area were hydro seeded in August 2012. <br />Environmental Protection Plan (EPP): <br />Henderson staff stated the Environmental Protection Plan (EPP) was expected to be submitted soon and <br />requested the plan be allowed to be submitted electronically. The Division received the EPP submittal (TR -19) <br />on October 5, 2012 and is under review. <br />Financial Warranty: <br />The financial warranty (bond) amount and type of warranty proposed to be submitted was discussed. The <br />Operator stated Climax reevaluated the financial warranty amount, but has not decided on the type of <br />warranty. The Division will evaluate the recalculated estimate once it is received by the Division. <br />Page 2 of 4 <br />
