PART I " <br />Page No. 3 <br />Permit No. COG-850000 <br />A. COVERAGE UNDER THIS PERMTT <br />• <br />1. This general permit authorizes dischazges [haz wasist entirely or principally of precipitation-induced surface runoff from <br />coal mining and processing operations including loadouts, while active mining is occurring or during reclamazion prior to <br />final bond release, into wazers of the Staze of Colorado. If additional sources which the Division determines to be minor <br />in nature such as selected mine water, preparazion plant water, spoils spring water or other wastewater tray be <br />dischazged, drew sounca may be covered under this permit az the Division's discretion providing that such wastewater <br />would not require effluent limitations and/or monitoring requirements other than those contained in this permit. Such <br />determinations will be made on a case-by case basis upon review of the permit application and any additional relevant <br />information. If discharge from one or more of the above listed sources require additional limitations and/or monitoring <br />requiremenu, an individual permit may be required. Multiple dischazge points from one facility may be authorized <br />through this permit providing all meet these criteria. <br />2. !n order [o apply for certification under this grneral permit, the owner, operator, and/or authorized agent of the subjec[ <br />facility shall submit by certified mail or hand delivery, the completed Coal Mining Wastewater Dischazge Application <br />(famished by the Division) which generally requires the following infortnazion (at a minimum): <br />a. Name, address, and descriptive location of the facility; <br />b. Name of principal in charge of operation of the facility; <br />c. Name of immediate receiving waters, (including irrigation ditches, intermittent streams and dry drainage, as <br />applicable); <br />d. Description of the type of activiry(ies) resulting in the dischazge, including the anticipated duration of the activity <br />andlor the dischazge, anticipazed volume and rate of discharge, and the source(s) of wazer to be discharged; <br />e. Description of any wastewater treatment system(s) and recycle/reuse utilized; <br />f. A topographic 8Yr z 11 inch map showing the general geographical location of the facility and any nearby landfills, <br />mine or mill tailings, or any other known or strspected sources of pollutants; • <br />g. An 8'~ x 11 inch sketch of the facility showing all structures, outfalls and receiving wazers, as well as storage <br />locations of any prtroteum or chemicals on site; and <br />h. A chemical analysis of the wazer to be dischazged. If no water is available, this shall be indica[ed. <br />If the discharge is to a storm sewer system, ditch or other manmade conveyance, approval from the owner of the system <br />must be obtained prior to discbarge. <br />At least 30 days prior to the anticipated daze of dischazge, such information shall be submitted on the application form <br />to: <br />Colorado Department of Public Health and Environment <br />WQCD-PE-82 <br />4300 Cherry Creek Drive South <br />Denver, CO 80222-1530 <br />The Division shall have up to thirty days afer re«ipt of the above information to request additional data or drny the <br />authorization to discharge. Upon receipt of additional information, the Division shall have an additional 30 days to issue <br />or deny authorization to discharge. If the applicant does no[ receive a request for additional information or a notification <br />of denial from the Division within thirty days, authorization to discharge in accordance with the terms and conditions of <br />the permit shall be deemed granted. <br />If the Division detertniaes that a new facility does not fall under the authority of the general permit, then the information <br />received will be processed for an individual permit and discharge will not be allowed until 180 days after the daze the <br />application was received. The applicant shall be notified of such a determination. If during the renewal process, the <br />Division determines that a facility no longer qualifies for the general permit, the facility will be allowed to discharge <br />under the general permit until an individual permit is issued. • <br />3. Authorisation to discharge under this general permit shall expire on June 30. 2002. The Division must evaluate this <br />general pertni[ once every five years and must also recertify all applicants' authority to dischazge under the general <br />permit az such [ime. Therefore, a permittce desiring continued coverage under the general permit mutt reapply by <br />Janusrv 1, 2002. The Division will determine if the applicant continues to operate tinder terms of the general permit. <br />
