NWCC visited the site on September 14 and 27, 2012. Based on the
report, NWCC did not observe any signs of instability, structural weakness or hazardous conditions at
the pile. These observations reflect observations with on-site inspections conducted by the Division of
the Waste Pile. The report states that the wash plants produced approximately 509,092 tons of waste
coal. On September 14, 2012 a total of four compaction tests were conducted at the Expansion Area.
All tests met the minimum compaction requirement of 90% of the maximum standard Procter density.

As of the date of the report, no new stripping of topsoil and cover materials was conducted and no new
haul road construction had taken place.

If you have any questions feel free to contact me.
