Mr. Ron Thompson Page 2 of 2 October 10, 2012 <br />NECC provided updates to permit page 2.05 -21. One correction needs to be made to this revised page. <br />Following the statement, "Should the sample mean for the reclaimed area be less than 90 percent of <br />the success standard, the following hypothesis testing formula will be utilized to demonstrate the <br />difference is not statistically* significant." NECC followed this statement with the Kupper and Hafner <br />sample adequacy* formula (formula la). This sample adequacy* formula is appropriate for data that is <br />less than the reclamation standard. Howerver, this formula is to show the sample data adequately* <br />represents the sampled area. The null formula is stated as: Ho: u >Q. <br />Q= 90% of standard, u =bond release block mean. <br />Please refer to the Division's "Guideline regarding selected Coal Mine Bond Release Issues ", dated <br />April 18, 1995, for the appropriate formulas. <br />Please bring page 2.05 -21 into agreement with the correct reclamation success formula. <br />The Division requested that NECC document the volume of topsoil reapplied to the NW vent shaft <br />reclaimed area. <br />NECC provided an estimate of the total volume to topsoil available in the topsoil stockpile at the time <br />of the NW vent shaft was reclaimed, and that it was all used, resulting in less than 2 inches of soil <br />applied over the remaining reclaimed area. This estimate is acceptable. <br />6. NECC provided an incidental boundaiv revision and revised map. <br />Revised Map 3 shows the permit area boundaiv truncated west of County* road 23.3. Based on map <br />10 -B showing the NW vent shaft prior to reclamation, a portion of the access road had extended to the <br />county road and has been reclaimed. The Division considers that this reclaimed area must be retained <br />in the permit area until it has received appropriate bond release. Review of SL6 approval does not <br />indicate that the Divisin previously* released the liability* on this portion of reclaimed access road. <br />Please assure that this reclaimed area remains in the Golden Eagle permit boundaiv. A copy* of Map <br />10 -B is included with this letter. Please revise map 3 to reflect inclusion of this reclaimed area. <br />The Division's proposed decision date is scheduled for October 29, 2012. Please provide responses to items <br />No. 4 and No. 6, prior to the proposed decision date. <br />
