Loretta Pineda <br />October 5, 2012 <br />Page 2 of 2 <br />On August 14, 2012, in fulfillment of Abatement Step #1, GCC submitted an application for <br />Technical Revision No. 20 (TR -20). The TR -20 application included the Trautner and CDS <br />reports, but specific details regarding the proposed final configuration for placement of coal mine <br />waste were not provided. The Division found the TR -20 application to be incomplete on August <br />22, 2012, and GCC is working to complete the necessary designs for the coal mine waste to meet <br />the performance standards criteria. TR -20 will provide plans for underdrains, slope stability, <br />final grade, final revegetation and other standards as required. GCC will work with contractors <br />to ensure the coal mine waste on the portal bench will either be relocated to the approved refuse <br />pile or rehandled so that the material will achieve all performance standards. <br />Current Request <br />GCC continues to diligently work toward abatement of the NOV as discussed in the attached <br />letter, and has submitted a request for extension of Abatement Step #2 to November 30, 2012. <br />GCC has committed to the relocation and /or reconstruction of the coal mine waste on the portal <br />bench and portal highwall being completed by November 30, 2012. However, Rule <br />5.03.2(2)(c)(g) limits an extension to 90 days. Therefore, I recommend that the final abatement <br />deadline be set at November 30, 2012. <br />If you have any questions, please contact me. <br />
