TR -18 to Permit M- 1977 -342 <br />Environmental Protection Plan <br />1. INTRODUCTION <br />1.1. Purpose and Objectives <br />In April 1994, the Colorado Mined Land Reclamation Board (Board) approved and promulgated <br />amendments to the Mineral Rules and Regulations under the Colorado Mined Land Reclamation <br />Act (Act). The most important of these changes was the classification and definition of a <br />"Designated Mining Operation" and the addition of Section 6.4.21 EXHIBIT U - Designated <br />Mining Operation Environmental Protection Plan to Rule 6. <br />A Designated Mining Operation (DMO) is defined as a mining operation where designated <br />chemicals used in metallurgical processing are present on -site; or toxic or acid - forming materials <br />will be exposed or disturbed as a result of mining operations; or acid mine drainage occurs or has <br />the potential to occur due to mining or reclamation activities. <br />The Colorado Department of Natural Resources (CDNR), Division of Minerals and Geology <br />(DMG), the agency that administers the Colorado Mineral Rules and Regulations, formally <br />notified the Henderson Mine and Mill that it was a DMO on August 3, 1994 (letter to Mr. Jay <br />Jones). Climax Molybdenum Company — Henderson Operations (Henderson) concurred with the <br />designation on August 31, 1994 (letter to Mr. Bruce Humphries, DMG). The DMG is now the <br />Division of Reclamation, Mining and Safety (DRMS) and will be referred to as that agency <br />throughout the rest of this document. <br />The purpose of this Environmental Protection Plan (EPP) is to provide a description of <br />environmental protection facilities for those areas that potentially could be affected or impacted <br />by designated chemicals, toxic or acid - forming materials or acid mine drainage. <br />The original Henderson Mine and Mill EPP was submitted as Technical Revision 04 (TR -04) to <br />the existing Regular (112) Mining and Reclamation Permit (Number M -1977 -342). This TR <br />supersedes TR -04 and, once approved, will become part of the existing permit. The objective of <br />this document is to update the EPP to reflect conditions as of the date of this plan. <br />1.1.1. Reference and Indexing <br />Since the Henderson Mine and Mill is an existing active operation with an approved Mining and <br />Reclamation Permit (Permit), much of the information and data required for the EPP has been <br />developed previously. Where such information is already part of the public record and official <br />reclamation Permit files (modifications to the Permit via Amendment (AM) or Technical <br />Revision (TR), correspondence with DRMS, etc.), that information is referenced but not <br />reiterated herein. Only information that presently is not part of the public record or is required <br />specifically under the Act is included. <br />1.1.2. Changes in Referenced Information and Documents <br />Changes in the reclamation plan can trigger the need for submittal of a formal Amendment, <br />Technical Revision, or Modification depending upon the type of change as defined by the <br />following definitions: <br />Technical Revision — means a change in the permit or applications, which does not have more <br />than a minor effect upon the approved or proposed Reclamation or Environmental Protection <br />Plan. <br />Climax Molybdenum Company <br />Henderson Operations <br />October, 2012 <br />Page 1 of 40 <br />
