Faul t <br /> Mr. Mulhall proposed that the fault component be cut in half since the <br /> Division overlooked this requirement during the review process. I have <br /> considered his proposal , but I ao not feel it is appropriate. It's unfortunate <br /> the Division overlooked the sediment control plan, but it is the operator 's <br /> responsibility to ensure compliance with all performance standards. <br /> Additionally, as I reviewed the correspondence associated with NOV C-89-013, <br /> comment 12 on page 3 of the Division 's April 23 , 1984 review letter requested <br /> a drainage control plan for another proposed topsoil stockpile. The operator <br /> should be aware of the need for sediment control . I believe the proposed <br /> penalty is appropriate. <br /> Good Faith <br /> Hay bales were acquired and placed on May 26 which abated Step 1 . Step 2 was <br /> abated on June 15, the same day the NOV was received by the operator. <br /> Mia-Continent Resources Inc. submitted a revision for a containment area at <br /> the base of the completed stockpile. I believe this is the shortest time <br /> possible and represents an extraordinary effort by the operator for correcting <br /> the on-site problem as soon as it was identified. .
