GENERAL COMMENTS <br /> This was a complete oversight oversight inspection. The schedule <br /> for the inspection of this mine resulted from a statistically drawn <br /> sample of the mines in Colorado for the third quarter of the year . <br /> The State was notified about my intent to inspect and conducted a <br /> joint inspection with me, despite the fact that they had conducted a <br /> complete inspection the week prior this one. <br /> II . ENFORCEMENT ACTIONS <br /> The State has an enforcement action pending abatement on the mine. <br /> Notice of Violation No. C-89-003 was issued for the company' s failure <br /> to maintain their rock tunnel dump ponds' A number of modifications ` <br /> have been issued for the violation requiring additional data as well <br /> as field compliance. It appears as though most of the requirements <br /> have been met but the violation was not abated during this <br /> inspection. <br /> Following this inspection additional enforcement actions were taken <br /> by both this office and the State of Colorado. It was found that the <br /> company failed to comply with a number of the terms and conditions of <br /> their permit as well as one of the performance standards. <br /> The State wrote a violation for the company' s failure to comply <br /> with a small area exemption. The area under the coal conveyor <br /> beltline between the rock tunnel portal and the "D" seam stockpile is <br /> not supposed to have any coal spilled on the surface according to the <br /> conditions of the exemption. The beltline is designed to be self <br /> cleaning so no spillage is to occur but it appears as though the belt <br /> was not centered proper] y on the overhead rollers, spillage occured. <br /> Mine run coal was noted in piles under the conveyor along the entire <br /> length of the beltline. The drainage control for the area consists of <br /> a series of ditches, pipes and waterbars that direct overland flow <br /> and disturbed area water into the haul road drainage system. From <br /> their , it drops into a receiving stream with no treatment required <br />
