Box 158
Carbondale, Colorado 81623
Re: Coal Basin Mines
Our File No. C-017-81
Dear Mr. Bowman-
As stated in our phone conversation of Thursday, Play 24, 1982, the Division
will not be issuing a Notice of Violation for failure to follow the
approved mine plan concerning the disposal of trommel screen rock in the
rock tunnel waste disposal area. However, the Division is very concerned
over the failure of Mid-Continent to notify the Division of this change
and receive Division approval prior to its inception. Mid-Continent must,
in the future, notify the Division in the form of a minor revision or
technical revision when any change in the mining and reclamation plan or
change in facilities, etc. are necessary. This is particularly important
for keeping the approved permit application. current.
There have been two other incidents in the past year which contribute to
the Division's concern. These are the construction of an additional
sediment pond near mines #1 and #2 and remodeling the preparations plant.
Although these activities generally result in no significant environmental
damage, the Division should have been notified of these changes, as
required by the Act and Rules and Regulations.
Future failure to follow the approved mine plan may result in enforcement
action.
If you have any questions concerning this matter, please call.
Sincerely,
i Herron
Reclamation specialist
JH/mt
