Specifically , failure to maintain the <br /> sediment control system so as to provide acceptable detention time. <br /> ACT, REGULATION, OR PERAIT PROVISION(S) VIOLATED: <br /> ACT SECTION(S) 34-33-121(2)(i ) ( II) <br /> REGULATION SECTIONS) 4.05. 1( 1) and 4.05.2(9) <br /> PERMIT SECTIONS) <br /> PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br /> Sediment control system for the coal preparation plant area. Specifically, <br /> the coal slurry pond at the wash plant and the series of 4 sedimentation ponds <br /> below the refuse pile. <br /> STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION) : <br /> Remove accumulated sediments from the coal slurry pond and the upper two sedi- <br /> mentation ponds in the 4 pond series so as to allow for sufficient detention <br /> time to reduce suspended solids content of discharge water to acceptable <br /> levels. <br /> Take immediate action. <br />
