w
Mr. Gary G. Brouzman , Director
November 16 , 1983
Page Two
mines which encounter substantial snow fall in the winter
with the resulting heavy snow melt in the late Spring.
It is my understanding that the current 10 year/24 hour
event number is based only on rainfall events and does
not consider snow melt involvement in sediment control
systems and structures.
I appreciate the fact that technically , at this
time , we are in an enforcement proceeding and, therefore ,
it may be quite inappropriate to have discussions on such
policy and complex technical matters . It is for this
reason , that I request that the pending enforcement action ,
(i .e. , notice and order of September 29 , 1983) , be withdrawn
and that you stay the issuance of any amended notice and order
pending this requested opportunity for further discussion.
Following our telephone conversation on November 9th,
which was made at the suggestion of Dave Shelton, Director
of the CMLRD, I telephoned Ms . Kassin to advise her of
our discussion and my verbal request. A copy of this letter
is being sent to Ms . Kissin, Mr. Bob Hykan, the Colorado
Attorney General ' s representative to the CMLRD , and to
Dave Shelton.
I will await your further advice and decision on
this matter.
Sincerely,
DELANEY & BALCOMB, P.C.
David R.
