A representative from <br /> AFO will attend the meeting. <br /> It has recently come to AFO's attention through a telephone conversation with a representative of <br /> the Division of Minerals and Geology (DMG) that DMG and representatives from Mid-Continent <br /> Resources have negotiated terms regarding the forfeiture of the bond. As you know, this bond lists <br /> D,MG and the Office of Surface Mining Reclamation and Enforcement (OSM) as co-payees. The <br /> Federal Lands Co-operative Agreement entered into between the State of Colorado and OSM <br /> states at Article IX (25) that an operator's performance bond shall be subject to forfeiture with the <br /> consent of OSM. <br /> Therefore, prior to completion of the forfeiture proceeding, OSM will need to review the action of <br /> the Board regarding the forfeiture of the bond and give our written consent to that action before it <br /> becomes final.
