31 <br /> hazard, due to trespassing, and that she wants some type of <br /> assurance that the reclamation work would be completed at the <br /> site. <br /> Mr. Long suggested that the matter be continued to the <br /> December 1993 Board Meeting, allowing the Division time to <br /> meet with Mr. Weaver on the site to compare bond calculations, <br /> taking into consideration any work that he has completed. <br /> The Board continued this matter to th December 15, 1993 Board <br /> Meeting, directed the Division to meet with Mr. Weaver by <br /> December 1, 1993, in an attempt to reduce the bond liability, <br /> and required the submittal of a proposed reclamation schedule <br /> during the December 15, 1993 Board Meeting. <br /> 22 . . FORMAL PUBLIC HEARING <br /> SUNLAND MINING COMPANY File No. C-81-011 <br /> Apex No. 2 Mine. During the July 1993 Board Meeting an issue <br /> was discussed, regarding the settlement agreement which the <br /> Board had previously entered into with the operator for the <br /> retention of a small portion of a highwall at the reclaimed <br /> site. Staff said that also during that time, the OSM' s <br /> objection to the settlement agreement was discussed. <br /> The OSM had requested that various options be explored to <br /> resolve the issue and ensure that the site could be considered <br /> a reclaimed operation. <br /> Staff presented a September 22, 1993 statement from the <br /> operator' s consultant, who had been present for this hearing, <br /> and stated that the operator would not object to an action <br /> terminating the settlement agreement. <br /> Staff asked the Board to terminate the settlement agreement. <br /> After the agreement' s termination, the operator will be <br /> required to submit a revision to the reclamation plan which <br /> contemplates total highwall elimination during the next <br /> construction season. <br /> The Board terminated the settlement agreement that had allowed <br /> for retention of the highwall at this site. <br /> 23 . ' FORMAL PUBLIC HEARING <br /> AMERICAN SHIELD COAL COMPANY File No. C-81-015 <br /> Fruita Mines. The Director, Michael Long, stated that this <br /> issue was the same as Item 22, regarding the Division' s <br /> request that a settlement agreement for the partial retention <br /> of a highwall be terminated. <br /> Mr. Long said that in this case, the landowner requested that <br /> a bench be left on the site, after reclamation. He said there <br /> is also an individual who indicated some plans to open another <br />
