Pineda <br />Director <br />We have received your minor revision application to revise your permit to conduct coal mining in Colorado. Our initial <br />review indicates that all preliminary items required by the Colorado Surface Coal Mining Reclamation Act, Section <br />34 -33 -101 et seq., C.R.S., have been submitted. Thus, your application has been considered complete for the purposes <br />of filing as of October 4, 2012. All review and comment periods as provided in the Act and the Regulations initiate from <br />this date of filing. <br />The Division has reviewed the revision application to determine whether the items you have submitted are adequate in <br />terms of meeting the requirements of the Act and Regulations. Two items required additional information: <br />1. The revised SWMP and SPCC specifies that it pertains to NPDES permit CO- 850045, and CO- 850006. <br />However, there is no discussion of conditions of material stored at the loadout. Please include an explanation <br />regarding the status of the loadout. If no "potential pollutant sources" are stored at the load out, please include <br />a statement to that effect. <br />2. EFCI provided a map showing the direction of runoff flow at the mine site. This map does not designate the <br />location of the storage location for the oil and grease containers. Please include the storage location on the <br />map. <br />The map submitted also has extraneous labels and information with no legend regarding what these labels refer <br />too. Please remove the labels or include the legend for the labels. <br />The proposed decision date is October 14, 2012.
