Richard T. Rains, P.H. <br />Partners Combined SWSP — Amendment #1 <br />October 1, 2012 <br />Page 4 of 5 <br />5. Approval of this SWSP is for the purposes as stated herein. Any additional uses of <br />this water must first be approved by this office. Any future historic consumptive use <br />credits sought for this site (e.g., agricultural water transfer) must consider all previous <br />credits applied. <br />6. The replacement water that is the subject of this SWSP cannot be sold or leased <br />to any other entity. As a condition of subsequent renewals of this SWSP, the <br />replacement water must be appurtenant to this site until a plan for augmentation <br />is obtained. A copy of this approval letter should be recorded with the county <br />clerk and recorder. All replacement water must be concurrent with depletions in <br />quantity, timing and locations. <br />7. Applicant shall replace the net evaporative depletions from the exposed ground <br />water surface area for any time that the exposed ground water in the pit is not <br />completely covered by ice. <br />8. The name, address, and phone number of the contact person who will be <br />responsible for the operation and accounting of this plan must be provided on the <br />accounting forms submitted to the division engineer and the water commissioner. <br />9. Adequate accounting of depletions and replacements must be provided to the <br />division engineer in Greeley (div1 accountinq(a,state.co.us) and the water <br />commissioner (Mark Simpson, Mark.Simpsonstate.co.us) on a monthly basis. <br />Submitted accounting shall conform to the Administration Protocol <br />"Augmentation Plan Accounting, Division One — South Platte River" (attached). <br />All amounts shall be in acre -feet. <br />a. In addition, the Applicant shall verify that the entities providing replacement <br />water for this plan have included and shown this use in their monthly accounting <br />submitted to this office. For this plan those entities are the City of Greeley <br />(WDID 0303330) and the East Larimer County Water Distrcit (WDID 0302563). <br />10. This SWSP may be revoked or modified at any time should it be determined <br />that injury to other vested water rights has or will occur as a result of this <br />SWSP. Should this SWSP expire without renewal or be revoked prior to <br />adjudication of a permanent plan for augmentation, all uses of water at the pit <br />must cease immediately. <br />11. The approval of this SWSP does not relieve the Applicant and /or the landowner <br />of the requirement to obtain a water court decree approving a permanent plan <br />for augmentation or mitigation to ensure the permanent replacement of all <br />depletions, including long -term evaporation losses and lagged depletions after <br />gravel mining has ceased. Granting of this SWSP does not imply approval by <br />this office of any such court application(s). <br />12. In accordance with amendments to §25 -8- 202(7), C.R.S., and "Senate Bill 89- <br />181 Rules and Regulations" adopted on February 4, 1992, the State Engineer <br />shall determine whether the substitute supply is of a quality to meet <br />requirements of use to senior appropriators. As such, water quality data or <br />analysis may be requested at any time to determine if the water quality is <br />appropriate for downstream water users. <br />
