BANTA, Director <br /> June 14, 1989 <br /> Mr. Robert Hagen, Director <br /> Albuquerque Field Office <br /> Office of Surface Mining Reclamation and Enforcement <br /> 625 Silver Avenue, SW, Suite 310 <br /> Albuquerque, New Mexico 87102 <br /> RE: TDN X-89-02-244-3-TV2, Coal Basin Mines (C-81-017) <br /> Dear Mr. Hagen: <br /> In regard to alleged violation No. 1 (Drainage from two acre topsoil pile) <br /> noted in the above-referenced TDN issued June 2, 1989 and received by this <br /> office June 5 , 1989 , the Division has issued NOV C-89-017 and will require the <br /> installation of interim drainage control for the stockpile by July 1 , 1989 as <br /> the required abatement. In addition, the operator will be required to submit <br /> a minor revision to the permit by July 1 , 1989 covering the drainage measures <br /> to be implemented upon completion of the stockpile. As a result of the above, <br /> the Division considers it is taking appropriate actions since they are <br /> authorized by the State program and will cause the problem to be corrected. <br /> In regard to alleged violation No. 2 (Drainage off rock tunnel waste dump) <br /> also noted in the above-referenced TDN, the Division acknowledges that <br /> drainage from the area between the tunnel waste pile and the adjacent hillside <br /> could be improved but maintains actions described herein in regard to this <br /> problem are appropriate and the decision not to issue an NOV is for good cause. <br /> Materials relating to the tunnel waste pile appear on Maps 11-B-App. 3-2 <br /> through 11 -B-App. 3-5 of the permit renewal document. The section of the <br /> permit cited in the TDN is apparently entry 2.3.3 of Map 11-B-App. 3-5 which <br /> appears under the heading Disposal of Waste and says the "surface drainage of <br /> the pile shall be maintained throughout construction by grading the surface to <br /> a minimum slope of 2% and insuring that no surface depressions exist". The <br /> surface of the pile does not appear to have been entirely graded to a minimum <br /> slope of 2%, but this condition does not conflict with the requirements of <br /> entry 2.3.3 which only specify a minimum slope to insure drainage . There is <br /> no maximum limit established during constuction. The only significant surface <br /> depression existing on the surface of the pile is that created by the operator <br /> using a series of berms to contain the highly liquid pond cleanings removed <br /> from the mine tunnel ponds in February and March of this year. This placement <br /> was part of the abatement measures approved for NOV C-89-003; the longterm <br /> placement of pond cleanings from sediment ponds on the pile was approved March <br /> 15, 1988 as Minor Revision 08. By this approval , however, there has resulted <br /> an apparently unforseen conflict with the requirements of entry 2.3.3 for <br /> maintenance of the waste pile surface.
