The response was
reviewed and found to be appropriate. The TDN violation #1 response was
appropriate because MLRD issued NOV C-89-017 which addresses conditions
cited in the TDN. The TDN violation #2 response was appropriate because
of the action to correct the permit defect as described. MLRD's
requirement to revise the permit to eliminate the conflicts caused by
putting the pond cleanings on the waste pile and preventing positive
drainage off the pile is correct. This waste pile must have positive
drainage to designed and approved diversions and sedimentation ponds
throughout construction as well as after construction is completed.
If you have any questions, please call Gary Fritz at (505) 766-1486.
Sincerely,
Robert H. H gen, Director
Albuquerque Field Office
