Long, Coal Program Supervisor <br /> Mined Land Reclamation Division - { <br /> Department of Natural Resources <br /> 215 Centennial Building <br /> 1313 Sherman Street <br /> Denver, CO 80203 <br /> Re: Ten-Day Notice 89-02-244-5 <br /> Dear Mr. Long: <br /> In accordance with 30 CFR 842.11, the following is a written finding <br /> regarding the Mined Land Reclamation Division's (MLRD) response to the <br /> above Ten-Dav Notice (TDN) : <br /> On November 3, 1989, the Albuquerque Field Office (AFO) conducted a <br /> random sample oversight inspection of the Coal Basin Mining complex; <br /> the OSM inspector was accompanied by an MLRD representative. The <br /> inspection resulted in the issuance of TDN 89-02-244-5, dated November <br /> 14, 1989. The TDN was sent by certified mail and was received by MLRD <br /> on November 16, 1989. MLRD's initial response to the TDN was by a <br /> telephone call from Bill Crick to Gary Fritz on November 27, 1989. Your <br /> office's written correspondence regarding the TDN was received on <br /> December 12, 1989. AFO will consider this a timely response to TDN <br /> 89-02-244-5. <br /> One of the comments made in your response concerns your office's not <br /> receiving the Minesite Inspection Report (MEIR) as supporting <br /> documentation for the TDN. The MEIR should have been sent with the TDN. <br /> Hopefully, any disadvantage you had in responding to the TDN without <br /> benefit of the MEIR should have been offset by the close-out briefing <br /> for your inspector at the completion of the inspection. At that time, <br /> it was made clear what the OSM inspector considered a violation with the <br /> only question being whether your staff would take enforcement action for <br /> the violations noted. <br />
