This is an alleged violation of Rule 4.03.2(6) involving the <br /> '-road drain on two mine near old training station." As indicated in our <br /> earlier response, the Division assumes this is the drain to the Number 2 mine <br /> pond that appears on Map II-B-App. 7-Att. 1 . in Volume 3 of the permit <br /> package. The Division' s representative present during the inspection <br /> considered the drain adequately maintained in that there was sufficient rock <br /> protection in the channel and little evidence of erosion visible through the <br /> snow cover present at the time of inspection. The existence of the drain <br /> provides approved erosion control for the access road in question. <br /> It is the Division' s feeling that there was no violation of the cited rule at <br /> the time of the original inspection, however the drain will be reinspected <br /> during the week of January 2, 1990 to confirm this. <br /> Issue 2. This is an alleged violation of Rule 4.03.3(6) as cited in the <br /> Ten-Day Notice. The Division will reinspect the south fan road during the <br /> week of January 2, 1990, and if conditions exist that indicate a lack of <br /> maintenance leading to excessive erosion a violation will be issued. <br /> Issue 3. This is a possible violation of Rule 4.05. 5(2)(e) as cited, possibly <br /> brought about by inadequate maintenance of berms and ditches in the pad area <br /> above and south of the slurry pond. The Division shall reinspect the site <br /> during the week of January 2, 1990 to determine if the conditions identified <br /> in the TDN exist. If so the appropriate action will be taken. <br />
