An inspection was conducted January 3rd and 4th. Detailed <br /> below are the results of that inspection. <br /> Issue 1 . No violation of Rule 4 .03.2(6) existed at the time of the <br /> inspection. The road drain to the Number 2 Mine sediment ponds was being <br /> properly maintained, and there was no evidence of excessive erosion. The <br /> drainage control system was functioning as designed. All runoff was being <br /> contained as required. <br /> Issue 2. The south fan portal road was re-inspected by the Division on <br /> January 4 , 1990. Although there was considerable snow cover at the time, it <br /> appears that satisfactory maintenance work has been performed in the area by <br /> the operator. Berms have been established at two points where runoff had <br /> concentrated. In addition, the operator stated that the upper portion of the <br /> gully below the road had been filled with rock material to prevent additional <br /> erosion. <br /> At the time of the latest inspection there was no violation of Rule 4 .03.3(6) , <br /> however this area shall be thoroughly inspected when snowmelt permits to <br /> ensure that no further erosion has taken place . <br /> Issue 3. On Janury 4 , 1990, NOV C-90-002 was issued to Mid-Continent <br /> resources , for a violation of Rules 4.05 .5 (2 ) (e) and 4.05 .5 (1 ) (c) , in the area <br /> of the hillside south of the Slurry pond. The required abatement is to take <br /> appropriate measures , acceptable to the Division, to prevent additional <br /> erosion and to provide adequate surface water control for the area. Due to <br /> snow cover on the north-facing hillside the abatement time was set at 60 days. <br />
