Long, Coal Program Supervisor
Mined Land Reclamation Division
Department of Natural Resources
215 Centennial Building
1313 Sherman Street
Denver, CO 80203
Re: Ten-Day Notice 89-02-244-6, Coal Basin Mines
Dear Mr. Long:
In accordance with 30 CFR 842.11, the following is a written finding
regarding the Mined Land Reclamation Division's (MLRD) response to the
above Ten-Day Notice (TDN) :
The Albuquerque Field Office (AFO) received MLRD's response to the
above-noted TDN on January 19, 1990. AFO granted a 2-week extension to
the required 10-day response period, at MLRD's request, due to inclement
weather which delayed MLRD's follow-up inspection. AFO will, therefore,
consider this a timely response to TDN 89-02-244-6.
MLRD has indicated that the areas of alleged Violation Nos. 1 and 2 were
re-inspected and found to be in compliance with Colorado's approved
program. The areas have been properly maintained with remedial work
being recently accomplished by the operator. AFO, therefore, finds MLRD
to have shown good cause for not taking action in relation to alleged
Violation Nos. 1 and 2.
MLRD has issued Notice of Violation (NOV) C-90-002 for the erosion
identified in alleged Violation No. 3 of the TDN. AFO finds this
response to be an appropriate action to cause the violation to be
corrected.
