It was , specifically, <br /> NOV 79-V-18-3 , Inspection date - August 30-31 , 1979 . Apparently, <br /> their files are not up-to-date . In a later phone conversation, <br /> he indicated that there is concern as to the abatement of viola- <br /> tions 1, 3 and 5 of the NOV, and that could in turn have an <br /> adverse effect on our permitting . <br /> Because we have concluded that a greater formality is desirable <br /> in dealing with OSM, I have written Mr . Fritz to ask that he <br /> detail OSM' s concerns in writing, so that I can better respond <br /> to them. I 've heard nothing back, and so will wait for a letter <br /> from OSM to communicate further with them on the issue . <br /> However , it does occur to me that I should furnish MLRD a <br /> summary and copies of the relevant documents concerning the <br /> violation. This is really just intended for your records , in <br /> the event that OSM has inquiries to make of the state about <br /> this issue . <br /> As a summary : <br /> NOV 79-V-18-3 contained five violations . <br /> 1 . Fording a stream (crossing Coal Creek to access the <br /> lower sediment pond prior to reconstruction of the bridge over <br /> Coal Creek) . <br /> 2 . Failure to pass all surface drainage from the wash <br /> plant yard area through a sediment pond (the concrete ditch did <br /> not go far enough in the wash plant yard area and material was <br /> pushed onto the stream bank) . <br /> 3 . Operating without a permit at the railroad loadout <br /> at Carbondale . <br /> 4 . Contamination of topsoil near the temporary coal <br /> stock pile near the wash plant . <br />
