This composition makes it less than likely <br /> that any sediment loading will occur at the crossing. This is especially true <br /> since the crossing was used on one occasion. <br /> Extent of Damage: It is extremely unlikely that any damage that would occur would <br /> extend beyond the permit area. <br /> Negligence: The ford was used in a single instance to move a piece of construction <br /> equipment across the stream so that a sediment pond could be cleaned out. The <br /> potential damage that could have occurred by ignoring this problem is far greater <br /> than the problem created by a single crossing incident. <br /> Good Faith: These points are assessed due to the company's diligence in constructing <br /> a bridge. The company acted as quickly as work could be done. <br />
