STATE OF COLORADO
* * Roy Romer, Governor
1878` VU Roa
O
DEPARTMENT OF NATURAL RESOURCES
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTON, Director
July 10, 1987
Mr. Robert Hagen, Director
Office of Surface Mining
Albuquerque Field Office
625 Silver Avenue SW, Suite 310
Albuquerque, New Mexico 87102
Re: Ten-Day Notice No. 87-02-107-2
Dear Mr. Hagen:
The above referenced TDN was written for failure to dispose of sediment pond
clean-out material in accordance with the approved permit. Specifically,
disposal of material at the rock tunnel disposal area.
Review of our records indicates that this practice has been approved. The
rock tunnel disposal area section of the permit application discusses
placement of pond clean-out materials within the pile. Pages 100 and 101 of
Appendix II-B-3, volume 2 shows calculations for the amount of material to be
placed within the pile. In addition, a stability analysis was performed on
the pile under these conditions which demonstrated the pile would be stable
with the addition of clean-out material from the ponds.
Therefore, the operator is in compliance with the approved plan. Given this,
no violation exists at this time.
Hopefully, you will find this response appropriate. If you have any questions
please contact me.
Sincerely,
Michael B.
