I also am concerned about the placement of <br /> the material . It is being placed near the toe which historically is a <br /> place of water accumulation . I feel that it would be better to locate- <br /> the materia] in another zone of the pile. I have not had time to <br /> research the approvals for the pile but would hope that this was <br /> considered. <br /> One of the drainage control structures, a ten foot culvert , under <br /> the bin pad bench was partially blocked with soil , debris and rocks <br /> on the upstream end of the tube. It was blocked halfway for about a <br /> third of the tube. A �lide- dh undi �turbed area above the bench has <br /> pushed out into the drainage goinq through the tube. The to� of the <br /> slide is in the drainage. I was concerned about the blockage in the <br /> culvert and was prepared to write a ten day notice if M�s Thompson <br /> was not willing to issue a notice of violation. Before doing that we <br /> checked the storm design for the structure and found that it was put <br /> in for a 100 year storm which is more than adequate for the required <br /> storm of 20 yr 24 hours. Mr . Jones said that despite the design <br /> freeboard, he would clear the blockage. I also made the comment that <br /> it might be a good idea to pu] ] out the wood and debris on the slide <br /> face in the immediate area of the drainage basin in case a storm came <br /> through that went over the current high water mark. No TDN or notice <br /> of violation was issued. This area merits attention however , because <br /> the stream bed level has been elevated by the toe of the the slide. <br /> The culvert will more than likely always contain some load levels. <br /> The culvert on the road crossing above this one has been replaced <br /> recently because it was buried by the slide. The new one had no flow <br /> through it , the stream channel flow is still filtering through the <br /> old pipe even though it is under the cobbles in the stream bed. <br /> The two mine fan area was- checked for oil spills and debris, no <br /> problems noted. The two mine coal bin collapsed last winter ' the <br /> steel from the bin was cleared away and hauled to a temporary <br /> disposal area until it can he scraped . <br /> The mine plan and accompanying permits were reviewed at their <br /> loadout in Carbondale' Their mine permit , C-017-81 , expires May 31 , <br /> 1988' Their NPDES oermit , CO-0039136, for the loadout expires <br /> 12/31/91 . The NPDES permit , CO-000396, for the mines expires <br /> 12/15/8B. A renewal for the permit has been submitted as of 3/24/88. <br /> Their certificate of public liability insurance is carried by Marsh <br /> & Mclennan Inc . of Chicago and expireF 11/11/88. The most recent <br /> sediment pond self inspections for the mine and loadout was conducted <br /> 1 -19-8ED. The last quarterly certification of the "Bowman" wastepiIe, <br /> Sutey and Rock Tunnel Waste d1sposal area waE conducted 1/19/88. <br /> Their special use permits for Garfield and Pitkin county were in <br /> order . <br /> The loadout area was inspected no problem- noted with the <br /> exception of a fuel tanl: tha+ was not bermed . I asked Mr . Jones if <br /> his: spill prevention and containment plan for the area addressed the <br /> situation.
