An additional issue raised in MLRD's letter will also <br /> be addressed below. <br /> The Colorado regulations prohibit runoff from being directed over the <br /> face of a fill or waste bank. Snowmelt is considered runoff under <br /> drainage control and effluent limitation regulations. Therefore, <br /> snowmelt, in addition to precipitation event drainage, must not be <br /> directed over the outslope of a waste bank. <br /> MLRD had approved a revision to the Coal Basin Mining and Reclamation <br /> Plan allowing "snow" removal to be accomplished by pushing it over the <br /> top bench of the waste bank to the lower terrace levels. After further <br /> review of this revision, AFO finds this approach to snow removal to be <br /> acceptable subject to the following interpretations: <br /> 1. The material to be pushed over the top bench is snow. <br /> 2. Snowmelt/precipitation runoff will not be directed over <br /> the face of the waste bank; this will be prevented by <br /> proper grading techniques and/or berms. <br /> 3. The deposition of snow on the lower terrace levels will, <br /> in no way, hinder the designed functions of those <br /> terraces; i.e. , the terraces must drain at all times to <br /> stabilized channels. <br />
