Ar' <br /> 4. Mid-Continent Resources, Inc. requested an assessment conference which was <br /> held September 6, 1989. <br /> 5. The Division issued a proposed settlement agreement on September 18, <br /> 1989. The issuance of CO C-89-019 was affirmed and a civil penalty of $3700 <br /> was proposed based on $100 for history (since two violations during the <br /> preceding year had now completed administrative review); $1250 for <br /> seriousness, $500 for fault, and two separate days of violation. <br /> 6. On October 25, 1989, the Division received a written request for formal <br /> review of C-89-019 from Mid-Continent Resources, Inc. and $3700 for the <br /> Division to place in Escrow. <br /> 7. With proper notice to all affected parties , the hearing was scheduled for <br /> the November 15, 1989 Mined Land Reclamation Board meeting. <br /> CONCLUSIONS OF LAW <br /> Mid-Continent Resources, Inc. failed to maintain appropriate sediment control <br /> measures to prevent, to the extent possible, additional contributions of <br /> sediment to streamflow or to runoff outside the permit area as required in <br /> C.R.S. 34-32-121 (2)( i ) ( II ) and Rule 4.05.50 )(a). Cessation order C-89-019 <br /> was issued properly and issuance of the cessation order is affirmed. <br /> BOARD ORDER <br /> Based on the foregoing Findings of Fact, Conclusions of Law and pursuant <br /> provisions of C.R.S. 34-33-124(2), the Board hereby affirms that: <br /> 1 . Cessation Order C-89-019 was properly issued to the Mid-Continent <br /> Resources, Inc. Coal Basin Mines and, <br /> 2. The civil penalty shall be for one day of violation rather than two <br /> days.
