DRAFF Subject To Board Approval Minutes, November 15, 1989 �-�� -•--- On October 24 , 1989, the BLM determined that the site was on public lands and directed the operators that all toxic chemicals and other facilities be immediately removed from the site. On October 25 , 1989, the BLM notified the operator that a MLR permit should be obtained for this site. On October 26, 1989, MLRD notified the operator that possible mining without a permit was occurring at the site and noticed them for a Hearing for the October Board Meeting. Staff since talked with Mr. Rowe, who was present for this Meeting. Also, Staff contacted the Department of Health in Grand Junction and was told by a representative, Mr. Duane Watson, that he had spoken with Mr. McCurdy and Mr. Rowe in early October regarding this operation. He had told them that if there was no discharge from the vats, there would be no NPDES necessary for the site, and he suggested that they obtain a MLR permit prior to initiating operations. Staff presented EXHIBIT B - a Civil Penalty Worksheet, and related that the extraction, processing, the disposal of leachate and detoxified ore constituted a mining operation. Also, it was considered that the use of caustic and toxic reagents would impose a possible significant health and environmental impact. Staff then answered questions from the Board. Mr. Carl Rowe addressed the Board and presented information that he was not an operator/owner in this issue. He stated that Mr. O.K. McCurdy, from Louisiana, and Mr. Duane Murray, from Texas, were the operators at this site. Mr. Rowe related that he was hired by Mr. Darrell Maxwell , another partner, to conduct assay work. He presented EXHIBIT C - an October 10, 1989, letter from the Department of Health's Pana unction Office. That correspondence stated that the site had been inspected by the DOH in September and that no surface discharges were observed at that time, therefore, no discharge permit was required. Mr. Rowe further discussed the operation and the partnership. He provided the Division with contact information for Mr. McCurdy and Mr. Murray. It was MOVED that the Board continue this issue to the December Board Meeting;n order to allow Staff time to obtain and develop more information regarding this matter.
