DRAFF <br /> Subject To Board Approval <br /> Minutes, November 15, 1989 �-�� -•--- <br /> On October 24 , 1989, the BLM determined that the site was on public <br /> lands and directed the operators that all toxic chemicals and other <br /> facilities be immediately removed from the site. On October 25 , 1989, <br /> the BLM notified the operator that a MLR permit should be obtained for <br /> this site. On October 26, 1989, MLRD notified the operator that <br /> possible mining without a permit was occurring at the site and noticed <br /> them for a Hearing for the October Board Meeting. Staff since talked <br /> with Mr. Rowe, who was present for this Meeting. Also, Staff contacted <br /> the Department of Health in Grand Junction and was told by a <br /> representative, Mr. Duane Watson, that he had spoken with Mr. McCurdy <br /> and Mr. Rowe in early October regarding this operation. He had told <br /> them that if there was no discharge from the vats, there would be no <br /> NPDES necessary for the site, and he suggested that they obtain a MLR <br /> permit prior to initiating operations. <br /> Staff presented EXHIBIT B - a Civil Penalty Worksheet, and related that <br /> the extraction, processing, the disposal of leachate and detoxified ore <br /> constituted a mining operation. Also, it was considered that the use <br /> of caustic and toxic reagents would impose a possible significant <br /> health and environmental impact. Staff then answered questions from <br /> the Board. <br /> Mr. Carl Rowe addressed the Board and presented information that he was <br /> not an operator/owner in this issue. He stated that Mr. O.K. McCurdy, <br /> from Louisiana, and Mr. Duane Murray, from Texas, were the operators at <br /> this site. Mr. Rowe related that he was hired by Mr. Darrell Maxwell , <br /> another partner, to conduct assay work. He presented EXHIBIT C - an <br /> October 10, 1989, letter from the Department of Health's Pana unction <br /> Office. That correspondence stated that the site had been inspected by <br /> the DOH in September and that no surface discharges were observed at <br /> that time, therefore, no discharge permit was required. Mr. Rowe <br /> further discussed the operation and the partnership. He provided the <br /> Division with contact information for Mr. McCurdy and Mr. Murray. <br /> It was MOVED that the Board continue this issue to the December Board <br /> Meeting;n order to allow Staff time to obtain and develop more <br /> information regarding this matter.
