Based on the <br /> information provided in your request and discussions with the staff I have <br /> decided that NOV C-89-033 should not be vacated. It appears that there was a <br /> loss of topsoil and therefore the NOV should stand. However, your request may <br /> be given further consideration if you choose to continue the administrative <br /> review. <br /> Concerning NOV C-89-032, the mine ID sign. The sign has been in its current <br /> location of at least 10 years. Without the sign being adjacent to the state <br /> highway it would be very difficult for the public to know the vicinity of the <br /> mine. Given this, I feel that the existing mine ID sign should remain in its <br /> present location. In addition, I feel that Mid-Continent should establish a <br /> second mine ID sign at the intersection of the mine access road and county <br /> road. Given that the present sign has been in existence for over 10 years and <br /> the company has constructed an additional sign at the mine entrance, I am <br /> electing to vacate this violation. <br /> If you have any questions please contact me. <br /> Sincerely, <br /> D R.
