RE: Coal Basin Mines (C-81-017) NOvs C-89-032 and C-89-033,
Request by Operator to Vacate
On December 7 we received a request for assessment conference which should
also be treated as a request to vacate the violations. Both NOVs were written
as a result of a complete inspection on October 31 to November 3.
The mine ID Sian has for years been located at the intersection of the mine
access road and Highway 133 in Redstone, which is several miles away from the
permit boundary. Althouah the road does lead only to the mine site, it is a
public road until reaching the permit area. This may to a decree restrict
access to a National Forest trailhead, and in any case is a clear violation of
Rule 4.02.20 ) .
The topsoil Violation involves about a 100-foot length of an access road,
built in 1988, where trees and brush are orotrudinc from the road fill . The
Revision allowing this construction called for stripping of 1030 cubic yards
of topsoil , and my estimate is that approximately 20 cubic yards were buried
by the fill .
Although both issues involve minimal environmental impact, I cannot recommend
that either of them be vacated. If you would like further information, please
