BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> File No. C-81-017 <br /> ----------------------------------------------------------------- <br /> MOTION FOR APPROVAL OF SETTLEMENT AGREEMENT <br /> ----------------------------------------------------------------- <br /> IN THE MATTER OF MID-CONTINENT RESOURCES, INC. : <br /> ORDER TO SHOW CAUSE WHY PERMIT <br /> SHOULD NOT BE SUSPENDED OR REVOKED <br /> ----------------------------------------------------------------- <br /> Pursuant to the terms of the Prehearng Order , the Mined <br /> Land Reclamation Division ( "Division" ) hereby provides the par- <br /> ties to this action with a copy of the enclosed proposed Order . <br /> The Order proposed by the Division incorporates a settle- <br /> ment agreement to be signed by the Division and Mid-Continent <br /> Resources, Inc. ( "MCR" ) . The Division acknowledges that the <br /> Crystal Valley Environmental Protection Association ( "CVEPA" ) and <br /> the Garfield Citizens ' Alliance ( "GCA" ) have not entered into the <br /> agreement and that, therefore, the agreement is not a full and <br /> complete settlement of all issues in dispute in this case. The <br /> issue that is not resolved by the terms of the settlement agree- <br /> ment concerns the role to be played by CVEPA and GCA upon the <br /> entry of an order in this action. It is the Division' s position <br /> that the proposed Order , by allowing the CVEPA and GCA to peti- <br /> tion the Board for a hearing on any failure to comply with the <br /> terms of the agreement as incorporated into the Order , adequately <br /> addresses this outstanding concern. <br /> ACCORDINGLY, the Division respectfully requests the Board <br /> to approve of the settlement agreement and to issue the enclosed <br /> Order . <br /> GALE A.
