4. Objection by Mid-Continent to the recommendations may be filed within <br /> 30 days of receipt by Mid-Continent. Such objection shall be made in writing <br /> to the Division. Such disagreements will be settled between the Division/USFS <br /> and Mid-Continent, or may be subject to administrative and judicial review. <br /> E. Final Reclamation Schedule <br /> 1 . If the permit is not transferred to a successor permittee or the mine <br /> is not otherwise reactivated, Mid-Continent shall initiate and complete <br /> reclamation of the Coal Basin Mines and the Carbondale loadout site in <br /> compliance with the following schedule: <br /> a. January 15. 1992 <br /> Mid-Continent will report to the Division as to its plan, including a <br /> showing satisfactory to the Division of its capability to proceed <br /> with final reclamation of the mine property commencing June 1 , 1992. <br /> b. May, 1992 = October. 1992 <br /> Initiate and complete reclamation of Mine 1 , 2. 3, 4, and 5 portal <br /> areas. including portal sealing, structural demolition, backfilling <br /> and grading, revegetation, and installation of sediment controls. <br /> Also complete sealing of the adit/rock tunnel . Reclamation must <br /> commence no later than June 1 , 1992. <br /> C. May, 1993 - October, 1993 <br /> Complete reclamation of the adit/rock tunnel area, initiate and <br /> complete reclamation of the preparation plant area, refuse areas, <br /> roads, and conveyor facilities. Reclamation will entail facilities <br /> demolition, backfilling and grading, topsoiling, and revegetation. <br /> Roads will be decommissioned such that the post-mine land use <br /> objectives will be served. The road surfaces and cut and fill slopes <br /> will be stabilized to minimize erosion, and a low maintenance <br /> drainage control system will be installed in place of the current <br /> high maintenance system. <br /> d. May, 1994 - October, 1994 <br /> Initiate and complete reclamation of the Carbondale Rail Loadout. <br /> Perform any necessary repairs, maintenance or follow-up work as <br /> required at the Coal Basin mine site. <br /> e. October. 1994 until Final Bond Release <br /> Perform necessary drainage and sediment pond maintenance, <br /> environmental monitoring and otherwise maintain the site in <br /> compliance with all applicable statutes, regulations and permit <br /> conditions until final bond release. <br /> -5- <br />
