. i <br /> Minutes, January 22-23, 1992 22 <br /> In relation to a concern of the Division regarding the length of time <br /> it would take to realize the full cash value of the security, Mr. <br /> Delaney stated that there would be a cooperative effort by the operator <br /> and the Division to proceed before bankruptcy court and request <br /> appropriate orders for the rapid liquidation of the security. He <br /> stated that the operator would agree to the arrangement, if <br /> negotiations with Geneva Steel do not conclude in a timely manner. <br /> Mr. Jim Holden, whom the operator retained to provide representation in <br /> the bankruptcy matter, addressed the Board and briefly stated that the <br /> operator has not yet initiated a bankruptcy filing. He explained that <br /> the State, because of its regulatory responsibilities , could probably <br /> proceed forward with the operator, regarding reclamation requirements , <br /> if bankruptcy is filed. <br /> Mr. Roger Henriksen, representing Geneva Steel , addressed the Board and <br /> stated that Geneva Steel would like to provide support to the Division <br /> for a thirty-day extension consideration of permit revocation. 'He said <br /> Geneva Steel has been- involved the negotiation of an acquisition <br /> agreement with the operator. <br /> In response to an inquiry from the Board, Staff said that the site is a <br /> very difficult site, from an environmental standpoint, specifically due <br /> to the high elevation, 5 portal facilities in different locations , and <br /> an extensive network (12 miles) of roads . Staff said the site requires <br /> a very high degree of environmental maintenance, and the operator' s <br /> current financial situation has made it more difficult and problematic <br /> to maintain the site. <br /> Staff- s:ald- that one .of .the "condit•ions of_ the -Board .O.rder•".and" .Setticement. <br /> Agreement was the provision for a joint inspection' to be conducted by <br /> the Division in conjunction with the U. S. Forest Service. The Forest <br /> Service manages a large portion of the surface area, and they have <br /> issued special use permits for some sections which cover most of the <br /> roads . Issues of road drainage control and stabilization and sediment <br /> control have been ongoing. <br /> In July of 1991 the Division, in conjunction with the Forest Service, <br /> conducted an intensive inspection .of the site. During that inspection <br /> a number " of concern's were "identified regarding road " drainage <br /> maintenance, stabilization of cut and fill slopes , erosion (on and <br /> offsite) due to the discharges. Staff said that a total of 7 notices <br /> of violation were issued in September of 1991 , as a result of the <br /> inspection; 1 of the violations was subsequently vacated. <br /> The violations issued were for road maintenance issues and cleanup of <br /> non-coal waste, i .e. , non-usable equipment, general trash, etc. Three <br /> of the 6 violations were abated prior to this year' s early snowfall . <br /> The other 3 violations have not yet been fully abated, although using <br /> the resources available, significant progress was made to abate the <br /> violations. <br />
