Minutes, August 26-27, 1992 17 <br /> General , said all of the issues regarding the rock dust plant have not <br /> been resolved. However, he said that the Division has a certificate of <br /> insurance for the rock dust plant which indicates that it is properly <br /> insured. At the Board' s request, Mr. Holden said the operator would <br /> stipulate that no equipment would be removed from the rock dust plant, <br /> until a complete inventory has been completed. <br /> Mr. Holden said he has conducted lien searches , but has not had an <br /> opportunity to review the information collected. However, he said he <br /> should be able to determine whether the Division has a perfected lien <br /> on the contents of the rock dust plant through review of the <br /> information he has collected. Mr. Holden said the operator will be <br /> pursuing the possibility of including other property with the rock dust <br /> plant, in order to obtain additional funds for reclamation. <br /> Ms. Delaney said the demolition company with whom the operator has <br /> contracted, Machinery and Equipment Company, has a proposal for <br /> marketing and selling structures , facilities and equipment which they <br /> plan to present to the Board during the September 1992 . Board Meeting. <br /> She discussed this matter briefly. <br /> The Director explained that the Division prefers a resolution to this <br /> matter that would include selling the rock dust plant with the Division <br /> refraining from taking possession of the property, in order to avoid <br /> the liabilities that could be incurred. <br /> Mr. Frank Johnson discussed the reclamation schedule outlined in the <br /> original Settlement Agreement and requested that it be adopted by the <br /> Board. However, he said negotiations between the Division and the <br /> operator would continue, regarding the reclamation schedule and plan. <br /> It was MOVED that the Board take the action of permit revocation and <br /> endorse the proposed reclamation schedule on Page 5 of the Settlement <br /> Agreement, with modifications to be resolved between the Division and <br /> the operator, and allow operations to continue, regarding necessary <br /> site reclamation and salvage of equipment and structures . SECONDED AND <br /> PASSED 6 for (Cooley, Jouflas, Stewart, Danielson, Danni and McCannon) ; <br /> 1 abstained (Kraeger-Rovey) . <br />
