Minutes , April 2243, 1992 39 <br /> in order to allow the operator additional time to attempt to sell the <br /> mine. <br /> During the March 1992 Meeting, the operator presented a term sheet that <br /> had been established between the operator and Crystal Springs Coal , a <br /> wholly owned subsidiary of Geneva Steel of Utah. The term sheet, <br /> EXHIBIT A, was for the lease and/or purchase of the Coal Basin Mine , <br /> including an agreement and eventual closing. Staff said the matter <br /> woula be continued during the May 1992 Board Meeting and asked the <br /> Board to provide comments and concerns regarding the term sheet at that <br /> time. <br /> Staff said that originally the agreement required that a term sheet be <br /> signed by April 10, 1992. However, that deadline has been extended to <br /> April 30, 1992, due to the complexity of the process . Staff said <br /> closing should take place during the latter part of this summer. <br /> Staff said the Division met with representatives from the operator and <br /> Crystal Springs Coal.. on April 1 , 1992., in order .to discuss outstanding <br /> abatement- issues associated with NOVs issued from mid-1991 through <br /> 1992, as well as any outstanding permitting actions . Staff presented <br /> EXHIBIT B, a letter summarizing the April 1 meeting. Staff said the <br /> letter outlines all the outstanding permitting and enforcement actions <br /> for the operator, including actions necessary for Crystal Springs Coal <br /> to make the mine operational from a regulatory standpoint. Staff <br /> explained that extensions were given on certain permitting actions , in <br /> order to allow Crystal Springs Coal time to become familiar with the <br /> revisions , violations and for the weather to break for the performance <br /> of additional abatements . <br /> Staff said that Division has not yet received a request for a transfer <br /> of the permit. Therefore, Mid-Continent is still the responsible party <br /> for all permitting actions . Staff said Crystal Springs Coal has <br /> applied for a special use permit through Pitkin County and is <br /> proceeding with due diligence. Staff said it will take about 12 weeks <br /> for the County permitting process to be completed. <br /> Staff informed the Board that several governmental agencies with <br /> jurisdication over the mining activities will meet in Glenwood _Springs <br /> on May T2, 1992, in order to discuss concerns , requirements and <br /> overlapping jurisdiction. <br /> Staff said the hearing on the Show Cause , revocation and bond <br /> forfeiture will be reconvened during the May 1992 Board Meeting. <br /> Mr. Jim Holden, representing the operator, discussed the extension of <br /> the deadline for producing a signed agreement. He briefly discussed <br /> the bankruptcy proceedings and said a pending motion would authorize <br /> Crystal Springs Coal to advance funds to the operator for the <br /> maintenance expenses . Mr. Holden said he is working towards gaining <br /> support from the creditors committee which he said may be considered by <br /> the bankruptcy court. He answered questions from the Board . <br />
