in order to allow the operator additional time to attempt to sell the
mine.
During the March 1992 Meeting, the operator presented a term sheet that
had been established between the operator and Crystal Springs Coal , a
wholly owned subsidiary of Geneva Steel of Utah. The term sheet,
EXHIBIT A, was for the lease and/or purchase of the Coal Basin Mine ,
including an agreement and eventual closing. Staff said the matter
woula be continued during the May 1992 Board Meeting and asked the
Board to provide comments and concerns regarding the term sheet at that
time.
Staff said that originally the agreement required that a term sheet be
signed by April 10, 1992. However, that deadline has been extended to
April 30, 1992, due to the complexity of the process . Staff said
closing should take place during the latter part of this summer.
Staff said the Division met with representatives from the operator and
Crystal Springs Coal.. on April 1 , 1992., in order .to discuss outstanding
abatement- issues associated with NOVs issued from mid-1991 through
1992, as well as any outstanding permitting actions . Staff presented
EXHIBIT B, a letter summarizing the April 1 meeting. Staff said the
letter outlines all the outstanding permitting and enforcement actions
for the operator, including actions necessary for Crystal Springs Coal
to make the mine operational from a regulatory standpoint. Staff
explained that extensions were given on certain permitting actions , in
order to allow Crystal Springs Coal time to become familiar with the
revisions , violations and for the weather to break for the performance
of additional abatements .
Staff said that Division has not yet received a request for a transfer
of the permit. Therefore, Mid-Continent is still the responsible party
for all permitting actions . Staff said Crystal Springs Coal has
applied for a special use permit through Pitkin County and is
proceeding with due diligence. Staff said it will take about 12 weeks
for the County permitting process to be completed.
Staff informed the Board that several governmental agencies with
jurisdication over the mining activities will meet in Glenwood _Springs
on May T2, 1992, in order to discuss concerns , requirements and
overlapping jurisdiction.
Staff said the hearing on the Show Cause , revocation and bond
forfeiture will be reconvened during the May 1992 Board Meeting.
Mr. Jim Holden, representing the operator, discussed the extension of
the deadline for producing a signed agreement. He briefly discussed
the bankruptcy proceedings and said a pending motion would authorize
Crystal Springs Coal to advance funds to the operator for the
maintenance expenses . Mr. Holden said he is working towards gaining
support from the creditors committee which he said may be considered by
the bankruptcy court. He answered questions from the Board .
